1. ELIGIBILITY Win a One Year Supply of Wise Snacks
Sweepstakes (referred to as the “Sweepstakes”) is open to all legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years of age or the age of majority in their home state as of the date of entry. Employees, officers, directors and agents of Wise Foods (Sponsor and each of their respective parent companies, affiliates, subsidiaries, sales representatives, wholesalers, distributors, printers, and advertising and sweepstakes agencies (collectively, the “Sweepstakes Parties”) and members of the immediate families (parent, child, sibling and their respective spouses, regardless of where they reside) and households of each, whether related or not related, are not eligible to participate.
2. HOW TO ENTER: Sweepstakes starts at 10:00 a.m. Eastern Time (“ET”) on September 1 2016, and ends at 9:00 pm ET on September 7, 2016 (“Sweepstakes Period”). You may enter the Sweepstakes in one ways: Register on the www.wisestorefront.com. Winners will be picked at random from those who have signed up between September 1-7, 2016. 10 winners will win a one year supply of Wise Snacks equivalent to 4 6oz bags of Wise Snacks or larger per month for 12 months. No other method of entry will be accepted. Limit one (1) entry per person, regardless of method of entry.
3. RANDOM DRAWING AND PRIZES: Potential winners will be selected by random drawing on or about [September 8], from among all eligible entries received. Subject to verification of eligibility and compliance with the terms of these Official Rules, the potential winners will be declared the official winners of the Sweepstakes. The decisions of Sponsor are final and binding on all matters relating to this Sweepstakes.
4. Winner Notification: Potential winners will be responsible for fulfilling all requirements imposed on winner set forth herein. Potential winners will be notified via email of which they registered on wisesnacks.com. Sponsor will make up to (2) attempts over a forty-eight (48) hour period following the Sponsor’s selection to contact the potential winners. In the event that a potential winner does not respond within forty-eight (48) hours of the second contact attempt, such potential winner will be disqualified and an alternate potential winner may be selected by random drawing from among all remaining eligible entries received. Potential winner may be required to complete and where lawful, a Publicity/Liability Release within forty-eight (48) hours of being contacted.
5. LIMITATIONS OF LIABILITY: Sponsor reserves the right to cancel or modify the Sweepstakes if it becomes technically or otherwise corrupted
6. BINDING ARBITRATION: By entering this Sweepstakes participants agree that they may not sue the Sweepstakes Parties in court and that they waive any right to a jury trial. THE ARBITRATION OF DISPUTES PURSUANT TO THIS PARAGRAPH SHALL BE IN THE ENTRANT’S INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN THE CLAIMS OF OTHER PERSONS OR PARTIES WHO MAY BE SIMILARLY SITUATED. DO NOT ENTER THIS SWEEPSTAKES IF YOU DO NOT AGREE TO HAVE ANY CLAIM OR CONTROVERSY ARBITRATED IN ACCORDANCE WITH THESE OFFICIAL RULES.
7. GOVERNING LAW: By participating in the Sweepstakes, each entrant and prize winner agrees that to the extent permitted by applicable law: (1) any and all disputes, claims and causes of action arising out of or connected with the Sweepstakes, or any prize awarded, will be resolved individually without resort to any form of class action; (2) any and all claims, judgments and awards will be limited to the greater of (i) actual third-party, out-of-pocket costs incurred (if any) or (ii) the value of the Prize, but in no event will attorneys' fees be awarded or recoverable; (3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT OR PRIZE WINNER BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES, AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) ENTRANT AND PRIZE WINNER'S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF; and (5) this Sweepstakes is governed by the laws of the state of Pennsylvania without regard to its conflicts of law principles and any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, and except for the arbitration noted above all disputes shall be litigated exclusively before a court of competent jurisdiction located within the state of Pennsylvania; if any provision or provisions of these Official Rules shall be held to be invalid, illegal, unenforceable or in conflict with the law, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby; and (6) entrants shall be bound by these Official Rules.
8. GENERAL: The Sweepstakes is subject to all applicable federal, state and local laws. Void where prohibited or restricted by law.
9. SPONSOR: Wise Foods, Wise Foods, Inc. 228 Raseley Street Berwick, PA 18603-4533 USA] is the sole Sponsor of this Sweepstakes.
10. WINNERS’ LIST: For a list naming the Winners, mail a request and a self-addressed stamped envelope to be received by [October 30, 2016],to [One Year Supply of Wise Snack Winner’s List c/o [Wise Foods, Inc. 228 Raseley Street Berwick, PA 18603-4533 USA].
